This is the privacy policy applicable to the use of Rivulis Filter APP (including any new versions, updates, or supplements, if any, unless they come with a separate privacy notice), an application developed, managed and powered by SISTEMAS DE FILTRADO Y TRATAMIENTO DE FLUIDOS, S.L. and licensed to RIVULIS IRRIGATION LTD., an Israeli company domiciled at Menivim Tower, 1 Hatahana St., Kfar Saba, Israel 87, 22400 Monzón (Huesca), Spain (hereinafter, respectively, the “Privacy Policy” and “RIVULIS”).
With this Privacy Policy, RIVULIS tries to explain the purposes for which personal data may be processed when using Rivulis Filter APP, which personal data categories may be processed, what rights the data subjects are attributed by regulations related to personal data protection and how to exercise them.
You should read and accept this Privacy Policy and Rivulis Filter APP Terms of Use (“Rivulis Filter APP Terms of Use”) before downloading and using Rivulis Filter APP. The acceptance of the Rivulis Filter APP Terms of Use and Rivulis Filter APP Privacy Policy is a pre-condition to you becoming a user of the Rivulis Filter APP (hereinafter, “You” or “User”). If You accept Rivulis Filter APP Terms of Use and this Privacy Policy on behalf of a company, entity, or organization, you represent and warrant that you have appropriate authority to do it on its behalf, and references to “You” and “User” shall include and refer to such company, entity, or organization.
If You are an individual and You are accepting this Privacy Policy and Rivulis Filter APP Terms of Use on your behalf, You will be the identified or identifiable natural person of the personal data referred to below (hereinafter, “Data Subject”). If You are accepting this Privacy Policy on behalf of a company, entity, or organization, the “Data Subject” will be the individual representing it who is identified or identifiable in the personal data referred to below. In this event, You represent and warrant that you have informed the Data Subject or Data Subjects of the contents of this Privacy Policy and obtained their corresponding consent, when needed. In any case, RIVULIS may from time to time modify at its sole discretion, update or modify this Privacy Policy.

Rivulis Filter APP needs to be downloaded and installed in your Android-IOS portable device. Once done, to operate it, you need to (i) signup as user by creating a Rivulis Filter account, entering a valid email and choosing a password (hereinafter, respectively, the “Account” and the “Credentials”); and (ii) connect Rivulis Filter with the Device(s) (Rivulis Filter APP can manage multiple Rivulis Filters) by entering the Security PIN. You can change the Security PIN (by default 0000).
Therefore, RIVULIS does not ask specifically for personal data to register as User and operate Rivulis Filter APP. However, the natural personal doing the registration as individual User or in representation of a company, entity, or organization may be identified or identifiable in the valid email required for registration. Therefore, in this case and when providing notification and provision of support, if any, pursuant to Rivulis Filter Terms of Use, please note that RIVULIS may collect and process the following categories of personal data:

Rivulis Filter APP login data: password and security PIN (encrypted)
Personal data communicated during notifications or support contacts to RIVULIS, if any (non-mandatory): depending on the contact method used by the Data Subject to contact RIVULIS, name, phone number, email and address.

The personal data of the Data Subject are used to create an identification profile in Rivulis Filter APP. This will enable You to operate Rivulis Filter APP functions. Please refer to Rivulis Filter User Manual [v1.0] here for more information about the functionalities of Rivulis Filter and Rivulis Filter APP.
You may contact RIVULIS to notify certain events as provided in the Terms of Use (by way of example, to notify possible deviations, functioning problems or unexpected results of Rivulis Filter APP). For these purposes, it might be necessary to collect personal data of the contacting Data Subject.
Even if RIVULIS does not assume support obligations concerning the Rivulis Filter APP under the Rivulis Filter APP Terms of Use, You may contact RIVULIS to ask for information support, if needed, and RIVULIS may try to do its best efforts to answer You. For this purpose, it might be necessary to collect personal data of the contacting Data Subject.
The personal data referred to above may be used to improve RIVULIS or its Affiliates products and services, as well as to develop new products and services.
With prior consent, the personal data of the Data Subject could be processed for market surveys and statistical purposes, as well as to send promotional and commercial communications related to products and services offered by RIVULIS or its Affiliates.
For the purpose of signing up to the Rivulis Filter APP you are required to provide information that might be considered Personal Data. Refusal to provide such data will make it impossible for You to use the Rivulis Filter APP. The legal basis for the processing of your data for this is contractual compliance (please refer to Rivulis Filter APP Terms of Use).
The legal basis for processing Your data when contacting us concerning notifications about Rivulis Filter and Rivulis Filter APP or asking for support information, if available, is also contractual compliance or legitimate interest. Legitimate interest is also the legal basis for processing for purposes of development and improvement of products and services.
The legal basis for processing for statistical and marketing purposes is consent. Consent is freely given and may be revoked at any time by notifying the following email address: marcom@rivulis.com. Please remember that details of non-individual Users are processed for these purposes as provided in Rivulis Filter APP Terms of Use.
RIVULIS may communicate the personal data of the Data Subject to parties rendering services to RIVULIS, such as managing the infrastructure of perform maintenance on any information systems. They will process personal data referred to Data Subject as processors. RIVULIS maintains an updated list of processors. You may contact us should you require additional information at the following email address: marcom@rivulis.com. Additionally, RIVULIS may communicate the personal data of the Data Subject to RIVULIS’s Affiliates for the same purposes indicated above and to competent authorities if compulsory under applicable law and regulations.
To facilitate processing your information through the Rivulis Filter APP and by our service providers or Affiliates, we might transfer your information to countries outside the EU and UK. If we, we will do so under the terms of data transfer agreements which contain standard data protection contract clauses with adequate safeguards determined by the EU Commission and UK Information Commissioner’s Office.
RIVULIS will store the personal data of the Data Subject as long as you use Rivulis Filter APP, and after such use may continue to store them where needed to fulfil legal obligations and during liability periods provided by any applicable laws and regulations. RIVULIS will consider that You have ceased to use Rivulis Filter APP if You should not access it for 365 days and may cancel YourCredentials and Account afterwards, as well as at any if ceasing to offer Rivulis Filter APP or to maintain Your Account as provided in Rivulis Filter APP Terms of Use.
During the period in which RIVULIS holds or processes personal data of the Data Subject, the Data Subject may exercise the following rights at any time:
Right to access: right to confirm if processing of the personal data of the Data Subject is being performed or not, and, in such event, to request access to, or copies of, the Data Subject’s personal data, together with information regarding the nature of processing;
Right to rectification (correction): right to rectify the personal data held by RIVULIS, if the personal data are incomplete or inaccurate;
Right to erasure (right to be forgotten): in some circumstances (this right is not absolute), the Data Subject has the right to request that the personal data be erased;
Right to portability: in some circumstances, the Data Subject has the right to receive the Data Subject’s personal data in a structured, commonly used and machine-readable format to be transmitted to another controller;
Right to restrict processing: in certain circumstances, the Data Subject may ask for the restriction of the processing (in other words, limit the way RIVULIS may use the personal data) of the Data Subject’s personal data;
Right to revoke consent: as mentioned, consent is freely given and, where RIVULIS is processing on the basis of consent, may be revoked by the Data Subject at any time by notifying the following email address: marcom@rivulis.com.
Right to object: the Data Subject has the right to object to certain processing for grounds connected to the specific applicable situation, which, for purposes other than direct marketing purposes, will need to be balanced with the legitimate reasons of RIVULIS, if any, for continuing with processing.
Right to object to automated decision-making and profiling: the Data Subject has de right not to be subject to a decision taken without human intervention, including those based on profiling.

If the Data Subject considers that RIVULIS has not adequately processed the Data Subject’s personal data, the Data Subject’s personal data may contact us at marcom@rivulis.com. Subject to applicable law, the Data Subject has the right to lodge a complaint with its local data protection authority. If the Data Subject is in the EU, then according to Article 77 of the GDPR, a Data Subject can lodge a complaint to the supervisory authority, in the Member State of its residence, place of work or place of alleged infringement of the GDPR.
If the Data Subject is in the UK, the Data Subject can lodge a complaint to the Information Commissioner’s Office (ICO).

Please remember that Filtering Data, as defined in the Rivulis Filter APP Terms of Use, is not considered personal data and, therefore, is not governed by this Privacy Policy but only by Rivulis Filter APP Terms of Use, as provide therein.
